Return & Refund Policy

1. Scope & who can use it
This policy applies to consumers (natural persons acting for purposes outside their trade, business or profession) who purchase goods from Obsession Society via our website. Legal entities (companies) do not benefit from the EU/Romanian statutory right of withdrawal described below.

2. Statutory right of withdrawal (14 days)
Under Romanian and EU law you have the right to withdraw from a distance contract (online order) within 14 calendar days without giving any reason. The 14-day withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

If we have not informed you of your right to withdraw, this withdrawal period may be extended in accordance with applicable law.

3. How to exercise the right of withdrawal
To exercise the right of withdrawal, you must inform us (we recommend by e-mail) at: support@obsessionsociety.com (or by post to the address below) of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post or e-mail). You may use the Model Withdrawal Form (below) but you are not obliged to do so.

4. Deadline to return the goods
After you notify us of your withdrawal, you must send back the goods within 14 days from the date on which you informed us of your decision to withdraw. The deadline is met if you send the goods back before the 14 day period has expired.

5. Refunds — timing and scope
We will reimburse all payments received from you, including the costs of standard delivery (i.e., the least expensive delivery method we offered), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied proof of having sent back the goods, whichever comes first.

We will refund using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise. If you asked for a different, more expensive delivery method than the standard one offered, we are not obliged to reimburse the additional cost for that more expensive delivery.

6. Return shipping costs
Unless otherwise stated on our site at the time of purchase, you (the consumer) are responsible for the direct cost of returning the goods. If the goods are defective, damaged, or we shipped the wrong item, we will bear the cost of the return.

(If you prefer to offer free returns to remain competitive, replace the previous sentence with: “We will pay the cost of return shipping for all returns within the statutory 14-day withdrawal period.”)

7. Condition of returned goods & liability for diminished value
You may handle and examine the goods in the same way you would in a shop. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (e.g., wearing the item beyond trying it on may reduce the refund). We reserve the right to deduct from your refund an amount corresponding to any diminished value of the goods caused by your handling.

8. Exceptions & goods excluded from withdrawal
The statutory right of withdrawal does not apply to certain goods, including (non-exhaustive):
• Goods made to the consumer’s specifications or clearly personalised;
• Sealed goods which for reasons of health or hygiene cannot be returned and were unsealed after delivery (e.g., intimate apparel removed from sealed hygiene packaging) — if applicable;
• Perishable goods or goods liable to deteriorate rapidly;
• Sealed audio/video recordings or sealed software where the seal has been broken.

If an item you ordered falls into one of these categories, we will inform you at the product page and at the point of sale.

9. Faulty or non-conforming goods (legal guarantee)
Separately from your statutory right of withdrawal, you also have legal rights if the goods are faulty or do not conform to the contract. If a product is defective or not as described, please contact us at support@obsessionsociety.com or use the complaints procedure on our website; we will provide the legal remedies available under Romanian law (repair, replacement, price reduction or refund) and the 2-year legal guarantee applies.
